The Government’s Data Protection Reforms

This briefing will provide an overview of the potential impacts of the government’s proposal to overhaul Data Protection legislation, post-Brexit, with a specific concentration on the impact that may have on healthcare services.

In September 2021 the government launched a consultation ‘on reforms to create an ambitious, pro-growth and innovation-friendly data protection regime that underpins the trustworthy use of data’. Over 550 organisations responded to the consultation, of which ten were specifically NHS-related.

This briefing will draw out some of the main proposals as fleshed out in the government’s response, which was published in June 2022 and draw common sense conclusions as to how they are likely to apply to healthcare settings, and the impact they may have.

Acknowledging that the likely new Data Protection legislation will influence all sectors, and that its likely content has been published alongside the NHS-specific Data Saves Lives policy paper from the Department of Health and Social Care, it will look at proposals including:

  • Implementation of a risk-based privacy programme
  • Removal of the obligation to have a Data Protection Officer
  • Removal of the obligation to undertake Data Protection Impact Assessments
  • Significant revision of what we currently know as Records of Processing Activities requirements
  • Removal of the obligation to consult the Information Commissioner with regard to high-risk data processing
  • Retention of free Subject Access Requests, while being able to deny those that are vexatious or excessive
  • Revisions to the Privacy and Electronic Communication Regulations.

Andrew is an award-winning Data Protection author, and Fellow of the Information and Records Management Society, with well over a decade of experience working in healthcare Information Governance and related processes. He has worked as an independent trainer and consultant for a number of years, as well as in Acute Trusts, Clinical Commissioning Groups, Commissioning Support Units, an independent sector hospital and given pro bono consulting for a local charity.

Barry is an Information Governance and Data Protection practitioner of many years standing, formerly as the Head of Information Governance for an NHS Trust and more recently as an independent consultant. His passion is to make the subject interesting and understandable for all. He is a Fellow of the Information and Records Management Society and in 2020 received the Information Commissioner’s Practitioner Award for Excellence in Data Protection.
